Health insurance companies must bezuschussen also in the future artificial fertilizations only at married couples.
That has the Federal Constitutional Court in its judgement of 28.02.2007 (AZ.: 1 BvL 5/03) decided.
For not conjugal partnerships there is thereby also further no requirement on health insurance company achievements for artificial fertilizations. They must be responsible even for the treatment. According to Federal Constitutional Court granting privilege of married partners, which get 50 per cent in such cases replaced by the legal cash, is compatible with the Basic Law.
In the reason is called it, the marriage offers in view of the existing legal obligations more security also for future children by both parents to be cared for.
Because the marriage is in principle put on on lifelong mutual responsibility, while unmarried ones would notice this responsibility only voluntarily.
Beyond that artificial fertilization is not disease treatment, but a medical measure, which is regulated also as such in the law.
