Easier further use of information of public places
Public places are the largest information producers in Europe
(openPR) - yesterday that stepped the law over the further use of information of public places (IWG) into force. The law converts the European guideline 2003/98/EG over the further use of information of the public sector into German right, whereupon the industry magazine EUROPATICKER environmental call (www.europaticker.de) refers to. Public places are the largest information producers in Europe, their information existence save an important economic capacity. The economic value of these information in the European union becomes estimated on 68 billion euro. The IWG will contribute to make this potential better usable.
The IWG regulates not the entrance to information in the sense of the uninformativeness, but develops rather on the existing regulations (e.g. information liberty and environmental information laws of the federation and the countries). IWG specifies that in the cases, in which public places make their information available to the further use this repays in non-discriminating way, time near, without superelevated and as not as possible exclusively effected. It essentially concerns the conversion of the principle of equality as well as transparency defaults for public places. This applies also to legal entities of private law, as far as they notice public tasks.
Exclusive agreements of public places with individual enterprises are only permissible if for this a public interest exists. If a public place uses information, which provided it in the context of its public tasks, for own business activities, then it has to place these information also to all competitors to the same conditions to order.
In the legislative procedure the IWG was supplemented around a course of law assignment to the Administrative Courts. Just like with the information liberty law thereby always the Administrative Courts are responsible also with the information further use law for all law cases.
